Terms: By accessing this Web Site, you are agreeing to be bound by these Web Site Terms of Service ("TOS") and Privacy Policy (together, "Terms and Conditions of Use"), all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trade mark law. The Web Site is available only to individuals who are at least 13 years old.

Definitions: Bestwritersplace.com ("BWP") is an interactive writing network owned and operated by Publishing Pros Corp. ("PPC") on the World Wide Web of the Internet. Any mention of BWP in this TOS applies equally to PPC and vice versa. The focus of Bestwritersplace.com is to provide a prime, conducive atmosphere for writers to create fiction and non-fiction materials and to receive constructive feedback from other members in order for them to perfect their craft and for the enjoyment of those members and the general public. Advertising and/or additional content may be provided by our affiliates and other third parties.

  • "Work" is any material that has been created or is in the process of being created at BWP;
  • "Guest" means any person who is visiting the Web Site and has not logged into BWP;
  • "Member" means each person who has registered with the Web Site and has the right to login. There are currently two classes of members at BWP:
    -"Author" is a specific class of member who intends to write or who has written materials at BWP. Authors can also provide feedback to other authors at appropriate stages of the creative process.
    -"Critic" is a specific class of member who participates in the creative process by providing constructive feedback to authors and who may play a role in determining whether a work becomes available to guests.

Site Terms of Use Modifications: BWP may revise its TOS at any time without notice. By using this Web Site you are agreeing to be bound by the then current version of this TOS. It is solely your obligation to have read the Agreement.

Disclaimer: The materials on BWP's Web Site are provided "as is". BWP makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, BWP does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet Web Site or otherwise relating to such materials or on any sites linked to this site.

Equipment: You are responsible for obtaining and maintaining all telephone, computer hardware and other equipment needed for access to and use of this site and all charges related thereto.

Limitations: In no event shall BWP, PPC or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on BWP's Internet site, even if BWP or a BWP authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you. Your use of this web site is at your own risk. It comes as is and as available. Members accept all
responsibility, legal and otherwise, for the content upload, submitted to and posted on BWP.

Links: BWP has not reviewed all of the sites linked to its Internet Web Site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by BWP of the site. Use of any such linked Web Site is at the user's own risk.

Responsibility of Contributors: If you are a Guest or a Member and post material to the Web Site, or otherwise make (or allow any third party to make) material available by means of the Web Site (any such material, “Content”), You are entirely responsible for the content of, and any harm resulting from, that Content. That is the case regardless of whether the Content in question constitutes text, graphics, an audio file, or computer software. By making Content available, you represent and warrant that:

  • the downloading, copying and use of the Content will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark or trade secret rights, of any third party;
  • if your employer has rights to intellectual property you create, you have either (i) received permission from your employer to post or make available the Content, including but not limited to any software, or (ii) secured from your employer a waiver as to all rights in or to the Content;
  • you have fully complied with any third-party licenses relating to the Content, and have done all things necessary to successfully pass through to end users any required terms;
  • the Content does not contain or install any viruses, worms, malware, Trojan horses or other harmful or destructive content;
  • the Content is not spam, is not machine- or randomly-generated, and does not contain unethical or unwanted commercial content designed to drive traffic to third party sites or boost the search engine rankings of third party sites, or to further unlawful acts (such as phishing) or mislead recipients as to the source of the material (such as spoofing);
  • the Content is not libelous or defamatory, does not contain threats or incite violence towards individuals or entities, and does not violate the privacy or publicity rights of any third party;
  • the Content is not vulgar, profane, contain expletives or sexually explicit;
  • you have, in the case of Content that includes computer code, accurately categorized and/or described the type, nature, uses and effects of the materials, whether requested to do so by BWP or otherwise;
  • does not contain links that take the visitor to another Web Site in the same browser window, including a Web Site that you may own, without the express written consent of BWP. You may, however, include your own Web Site address in your biography, as long as the link has been disabled. You may also reference another Web Site in your article for the purpose of substantiating a statement. The link to such Web Site must open in a separate browser window.

By submitting Content to BWP you grant a world-wide, royalty-free, and non-exclusive license to reproduce, adapt and publish the Content for the purpose of displaying, distributing and promoting it. You also grant BWP the right to place in context ads within the body of your Content and to display ads which it deems appropriate. If you delete Content, BWP will use reasonable efforts to remove it from the Web Site, but you acknowledge that caching or references to the Content may not be made immediately unavailable.

As the author of the material, you retain the copyright of such material and you are urged to file the necessary paperwork to obtain legal copyright.  Please review our copyright policy where you can also obtain additional general information about copyrights.

Without limiting any of those representations or warranties, BWP has the right (though not the obligation) to, in its sole discretion, (i) refuse or remove any content that, in its reasonable opinion, violates any BWP policy or is in any way harmful or objectionable, or (ii) terminate or deny access to and use of the Web Site to any individual or entity for any reason, in BWP’s sole discretion.

Guest Comments: BWP wishes to make its Guests feel as welcome as possible and extend the courtesy of asking our Authors questions pertinent to the material Authors post or to leave comments and ratings on any material posted. Accordingly, we may append a Contact form to your Content. As the Author of the Content, you are not required to answer such questions or comments except that you understand that the answering of questions or comments and the quality of the answers may inure to your benefit and increase your credibility, although you understand that there is no guarantee that such will be the case.

Cost: There is never any cost to becoming a member of BWP. However, BWP does offer fee based services to authors which may be purchased. These services may include proofreading services, copy-editing services and promotional services.

Severability: If any part of this Agreement is held invalid or unenforceable, that part will be construed to reflect the parties’ original intent, and the remaining portions will remain in full force and effect. A waiver by either party of any term or condition of this Agreement or any breach thereof, in any one instance, will not waive such term or condition or any subsequent breach thereof.

Governing Law: Any claim relating to Publishing Pros Corp.'s web site shall be governed by the laws of the State of Delaware, U.S.A. without regard to its conflict of law provisions.
